Important Notices

Your Duty of Disclosure

You have a duty of disclosure under the Insurance Contracts Act 1984 as follows:

For Personal Accident  cover:
When answering our questions, You must be honest and You have a duty under law to tell the Insurer anything known to You, and which a reasonable person in the circumstances, would include in answer to the question. The Insurer will use the answers in deciding whether to insure You and anyone else to be insured under the contract of insurance, and on what terms.

It is important that You understand You are answering our questions in this way for Yourself and anyone else whom You want to be covered by the insurance.
If You do not answer our questions in this way, the Insurer may reduce or refuse to pay a claim, or cancel the insurance. If You answer our questions fraudulently, the Insurer may refuse to pay a claim and treat the insurance as never having existed.

For all other insurance cover:
Before You enter into a contract of insurance, You have a duty under law, to disclose to the Insurer every matter that You know, or could reasonably be expected to know, is relevant to the Insurer’s decision whether to accept the risk of insurance and, if so, on what terms.

You have the same duty to disclose those matters to the Insurer before You renew, extend, vary or reinstate a contract of general insurance.

Your duty however does not require disclosure of a matter:-

– that diminishes the risk to be undertaken by the Insurer;
– that is of common knowledge;
– that the Insurer knows or, in the ordinary course of its business, ought to know;
– where compliance with Your duty is waived by the Insurer.

If You fail to comply with Your duty of disclosure, the Insurer may be entitled to reduce its liability under the contract in respect of a claim or may cancel the contract of insurance. If Your non disclosure is fraudulent, the Insurer may also have the option of avoiding the contract of insurance from its beginning.

Privacy policy

We are committed to protecting your privacy.  We use the information you provide to us to quote on and insure your risks. We only provide personal information to our underwriters and reinsurers (and their representatives) and those we appoint to assist us with claims under your policy. We will not trade, rent or sell your information.

If you don’t provide us with full information, we cannot properly quote for your insurance and we cannot insure you.  You can check the personal information we hold about you at any time. For more information about our Privacy Policy, ask us for a copy.

Complaints and Dispute Resolution Process

Hostsure Underwriting Agency is Insurance Council of Australia’s General Insurance Code of Practice compliant, apart from any claims adjusted outside Australia.  Underwriters at Lloyd’s proudly support the General Insurance Code of Practice. The purpose of the Code is to raise standards of practice and service in the general insurance industry.  Any enquiry or complaint relating to this Insurance should be referred to the Coverholder in the first instance. If this does not resolve the matter or you are not satisfied with the way a complaint has been dealt with, you should write to:

Who will refer your dispute to Policyholder and Market Assistance at Lloyd’s.
Complaints that cannot be resolved by Policyholder and Market Assistance may be referred to the Financial Ombudsman Service (UK).  Further details will be provided at the appropriate stage of the complaints process.

The Underwriters hereon agree that:
(i)    In the event of a dispute arising under this Insurance, the Underwriters at the request of the Assured will submit to the jurisdiction of any competent Court in the Commonwealth of Australia. Such dispute shall be determined in accordance with the law and practice applicable in such Court.

(ii)    Any summons notice or process to be served upon the Underwriters may be served upon:

Who has authority to accept service and to enter an appearance on the Underwriters’ behalf, and who is directed at the request of the Assured to give a written undertaking to the Assured that he will enter an appearance on the Underwriters’ behalf.

(iii)    If a suit is instituted against any one of the Underwriters, all Underwriters hereon will abide by the final decision of such Court or any competent Appellate Court.

If you have any complaints about the service provided, you can contact our Complaints Manager on telephone (02) 9307 6600 or put your complaint in writing and send to Hostsure Underwriting Agency PO Box A2016, Sydney South NSW 1235. Please mark the envelope “Notice of Complaint”.  We will endeavour to resolve your complaint quickly and fairly.

The amount of Premium specified herein is the amount due to the Underwriters and any commission allowed by them is to be regarded as remuneration of the Coverholder placing this Insurance.


The premium payable by you will be shown on your policy and schedule.

We will take into consideration a number of factors in setting our premiums. These can include factors relating to the property being insured and the location of the property. In respect of liability insurance, the turnover and type of business operation could affect the premium payable.
